Geltungsbereich<br \/>Diese Allgemeinen Gesch\u00e4ftsbedingungen gelten f\u00fcr Vertr\u00e4ge \u00fcber die mietweise \u00dcberlassung von Apartments zur Beherbergung sowie alle damit verbundenen weiteren Leistungen und Lieferungen von Monschauer Apartments.<br \/>2. Vertragsabschluss<br \/>Der Vertrag kommt durch die schriftliche Best\u00e4tigung der Reservierung durch Monschauer Apartments zustande. Reservierungen sind f\u00fcr beide Parteien verbindlich, sobald die vollst\u00e4ndige Zahlung geleistet wurde. Diese Reservierung ist nicht \u00fcbertragbar.<br \/>3. Nutzung der Apartments und Verhalten der G\u00e4ste<br \/>Zusammenk\u00fcnfte und Feiern jeglicher Art sind in den Apartments nicht gestattet. Die Unterkunft beh\u00e4lt sich das Recht vor, zus\u00e4tzliche G\u00e4ste, die nicht in der Buchung enthalten sind, aus dem Apartment zu entfernen. G\u00e4ste, die den Anweisungen des Personals nicht folgen, sich diskriminierend \u00e4u\u00dfern, andere G\u00e4ste bel\u00e4stigen oder gef\u00e4hrden oder die Gesundheits- und Sicherheitsvorschriften der Unterkunft missachten, k\u00f6nnen von der Unterkunft verwiesen werden.<br \/>4. Pflichten des Gastes<br \/>G\u00e4ste sind verpflichtet, bei der Ankunft ein g\u00fcltiges Ausweisdokument vorzulegen. Der Gast ist verantwortlich f\u00fcr die Einhaltung der Hygiene- und Sicherheitsrichtlinien der Unterkunft. Der Gast hat f\u00fcr die Ordnung und Sauberkeit des Apartments Sorge zu tragen und muss sich stets an die Sicherheitsvorgaben halten. Jegliche Besch\u00e4digung oder Zerst\u00f6rung von Eigentum der Unterkunft wird dem Gast in Rechnung gestellt, sofern nachgewiesen werden kann, dass diese durch den Gast verursacht wurde.<br \/>5. Haftung der Unterkunft<br \/>Die Unterkunft \u00fcbernimmt keine Verantwortung f\u00fcr verloren gegangene, gestohlene oder verlegte pers\u00f6nliche Gegenst\u00e4nde. Fundsachen werden registriert und sicher aufbewahrt, jedoch nach einer gewissen Zeit entsorgt oder gespendet. Verderbliche Waren werden nur bis zum Ende des Auschecktages aufbewahrt.<br \/>6. Haftungsausschluss bei externen Einfl\u00fcssen<br \/>Die Unterkunft ist nicht haftbar f\u00fcr finanzielle oder sonstige Verluste, Verz\u00f6gerungen bei Reisen, Verletzungen, Sch\u00e4den oder Unannehmlichkeiten, die direkt oder indirekt durch Ereignisse au\u00dferhalb der Kontrolle der Unterkunft verursacht werden. Dies umfasst, ist aber nicht beschr\u00e4nkt auf: Flugversp\u00e4tungen oder -annullierungen, Unruhen, Fahrzeugausf\u00e4lle, Streiks, Diebstahl, terroristische Handlungen, Naturkatastrophen, Krieg, Feuer, \u00dcberschwemmungen, h\u00f6here Gewalt, staatliche Eingriffe, \u00c4nderungen in staatlichen Vorschriften oder Maschinen- und Ger\u00e4test\u00f6rungen.<br \/>7. \u00c4nderungen der Allgemeinen Gesch\u00e4ftsbedingungen<br \/>Die Unterkunft beh\u00e4lt sich das Recht vor, diese Bedingungen jederzeit ohne vorherige Ank\u00fcndigung zu \u00e4ndern. \u00c4nderungen werden unmittelbar auf der Website ver\u00f6ffentlicht. Es wird empfohlen, die hier ver\u00f6ffentlichten Informationen regelm\u00e4\u00dfig zu \u00fcberpr\u00fcfen, um auf dem neuesten Stand zu bleiben.<br \/>8. Schlussbestimmungen<br \/>\u00c4nderungen oder Erg\u00e4nzungen des Vertrags bed\u00fcrfen der Schriftform. Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die G\u00fcltigkeit der \u00fcbrigen Bestimmungen unber\u00fchrt.<\/p>\n<p><strong>Zahlungsbedingungen f\u00fcr Monschauer Apartments<\/strong><br \/>1. Vorauszahlung<br \/>Eine vollst\u00e4ndige Vorauszahlung ist erforderlich, um die Reservierung zu best\u00e4tigen. Die Zahlung muss innerhalb von 7 Tagen nach Erhalt der Buchungsbest\u00e4tigung erfolgen.<br \/>2. Nicht erstattungsf\u00e4hige Reservierungen<br \/>Bei nicht erstattungsf\u00e4higen Reservierungen wird der volle Betrag sofort nach Buchung f\u00e4llig. Es gibt keine M\u00f6glichkeit zur R\u00fcckerstattung im Falle einer Stornierung.<br \/>3. Erstattungsf\u00e4hige Reservierungen<br \/>Bei erstattungsf\u00e4higen Reservierungen (Standard Tarif, Spezialtarif ab 3 N\u00e4chten und Wochen Tarif) ist die Zahlung ebenfalls im Voraus erforderlich. Eine R\u00fcckerstattung ist nur im Falle einer rechtzeitigen Stornierung gem\u00e4\u00df den genannten Stornierungsbedingungen m\u00f6glich.<br \/>4. Zahlungsverzug<br \/>Wird die Zahlung nicht rechtzeitig geleistet, beh\u00e4lt sich Elbershof das Recht vor, die Reservierung zu stornieren. In diesem Fall k\u00f6nnen Stornogeb\u00fchren anfallen.<br \/>5. Rechnungsstellung<br \/>Alle Rechnungen sind am Tag der Abreise ohne Abzug zu begleichen, sofern nicht anders vereinbart.<\/p>\n<p><strong>Stornierungsbedingungen f\u00fcr Monschauer Apartments<\/strong><br \/>1. Stornierungen bei nicht erstattungsf\u00e4higen Reservierungen<br \/>Bei nicht erstattungsf\u00e4higen Reservierungen wird der volle Betrag sofort in Rechnung gestellt, und Stornierungen oder \u00c4nderungen sind nicht m\u00f6glich. Es erfolgt keine R\u00fcckerstattung.<br \/>2. Stornierungen bei erstattungsf\u00e4higen Reservierungen<br \/>Stornierungen sind bei erstattungsf\u00e4higen Reservierungen (Standard Tarif, Spezialtarif ab 3 N\u00e4chten und Wochen Tarif) bis zu 7 Tagen vor dem Anreisedatum kostenfrei m\u00f6glich. Geltungsbereich<br>1. Diese Gesch\u00e4ftsbedingungen gelten f\u00fcr Vertr\u00e4ge \u00fcber die mietweise \u00dcberlassung von Hotelzimmern zur Beherbergung, sowie alle f\u00fcr den Kunden erbrachten weiteren Leistungen und Lieferungen des Hotels.<br>2. Die Unter- oder Weitervermietung der \u00fcberlassenen Zimmer sowie deren Nutzung zu anderen als Beherbergungszwecken bed\u00fcrfen der vorherigen schriftlichen Zustimmung des Hotels, wobei \u00a7 540 Abs. 1 Satz 2 BGB abbedungen wird, soweit der Kunde nicht Verbraucher ist.<br>3. Gesch\u00e4ftsbedingungen des Kunden finden nur Anwendung, wenn dies vorher ausdr\u00fccklich schriftlich vereinbart wurde.<br>II. Vertragsabschluss, -partner; Verj\u00e4hrung<br>1. Der Vertrag kommt durch die Annahme des Antrags des Kunden durch das Hotel zustande. Dem Hotel steht es frei, die Zimmerbuchung schriftlich zu best\u00e4tigen.<br>2. Vertragspartner sind das Hotel und der Kunde. Hat ein Dritter f\u00fcr den Kunden bestellt, haftet er dem Hotel gegen\u00fcber zusammen mit dem Kunden als Gesamtschuldner f\u00fcr alle Verpflichtungen aus dem Hotelaufnahmevertrag, sofern dem Hotel eine entsprechende Erkl\u00e4rung des Dritten vorliegt.<br>3. Alle Anspr\u00fcche gegen das Hotel verj\u00e4hren grunds\u00e4tzlich in einem Jahr ab dem Beginn der Kenntnisabh\u00e4ngigen regelm\u00e4\u00dfigen Verj\u00e4hrungsfrist des \u00a7 199 Abs. 1 BGB. Schadensersatzanspr\u00fcche verj\u00e4hren kenntnisunabh\u00e4ngig in f\u00fcnf Jahren. Die Verj\u00e4hrungsverk\u00fcrzungen gelten nicht bei Anspr\u00fcchen, die auf einer vors\u00e4tzlichen oder grob fahrl\u00e4ssigen Pflichtverletzung des Hotels beruhen.<br>III. Leistungen, Preise, Zahlung, Aufrechnung<br>1. Das Hotel ist verpflichtet, die vom Kunden gebuchten Zimmer bereitzuhalten und die vereinbarten Leistungen zu erbringen.<br>2. Der Kunde ist verpflichtet, die f\u00fcr die Zimmer\u00fcberlassung und die von ihm in Anspruch genommenen weiteren Leistungen geltenden bzw. vereinbarten Preise des Hotels zu zahlen. Dies gilt auch f\u00fcr vom Kunden veranlasste Leistungen und Auslagen des Hotels an Dritte.<br>3. Die vereinbarten Preise schlie\u00dfen die jeweilige gesetzliche Mehrwertsteuer ein. \u00dcberschreitet der Zeitraum zwischen Vertragsabschluss und Vertragserf\u00fcllung vier Monate und erh\u00f6ht sich der vom Hotel allgemein f\u00fcr derartige Leistungen berechnete Preis, so kann dieses den vertraglich vereinbarten Preis angemessen, h\u00f6chstens<br>jedoch um 5% anheben. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>4. Die Preise k\u00f6nnen vom Hotel ferner ge\u00e4ndert werden, wenn der Kunde nachtr\u00e4glich \u00c4nderungen der Anzahl der gebuchten Zimmer, der Leistung des Hotels oder der Aufenthaltsdauer der G\u00e4ste w\u00fcnscht und das Hotel dem zustimmt. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>5. Rechnungen des Hotels sind am Abreisetag ohne Abzug zu zahlen. Das Hotel ist berechtigt, aufgelaufene Forderungen jederzeit f\u00e4llig zu stellen und unverz\u00fcgliche Zahlung zu verlangen. Bei Zahlungsverzug ist das Hotel berechtigt, die jeweils geltenden gesetzlichen Verzugszinsen in H\u00f6he von derzeit 8% bzw. bei Rechtsgesch\u00e4ften, an denen ein Verbraucher beteiligt ist, in H\u00f6he von 5% \u00fcber dem Basiszinssatz zu verlangen.<br>Dem Hotel bleibt der Nachweis eines h\u00f6heren Schadens vorbehalten. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>6. Das Hotel ist berechtigt, bei Vertragsschluss eine angemessene Vorauszahlung in Form einer Kreditkartengarantie oder Sicherheitsleistung zu verlangen. Die H\u00f6he der Vorauszahlung und die Zahlungstermine k\u00f6nnen im Vertrag schriftlich vereinbart werden. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>7. Der Kunde kann nur mit einer unstreitigen oder rechtskr\u00e4ftigen Forderung gegen\u00fcber einer Forderung des Hotels aufrechnen oder mindern.<br>IV. R\u00fccktritt des Kunden (z.B. Abbestellung, Stornierung) \/ Nichtinanspruchnahme der Leistungen des Hotels<br>1. Ein R\u00fccktritt des Kunden von dem mit dem Hotel geschlossenen Vertrag bedarf der schriftlichen Zustimmung des Hotels. Erfolgt diese nicht, so ist der vereinbarte Preis aus dem Vertrag auch dann zu zahlen, wenn der Kunde vertragliche Leistungen nicht in Anspruch nimmt. Dies gilt nicht bei Verletzung der Verpflichtung des Hotels zur R\u00fccksichtnahme auf Rechte, Rechtsg\u00fcter und Interessen des Kunden, wenn diesem dadurch ein Festhalten am Vertrag nicht mehr zuzumuten ist oder ein sonstiges gesetzliches oder vertragliches R\u00fccktrittsrecht zusteht. > Siehe auch Buchungsbestimmungen<br>2. Sofern zwischen dem Hotel und dem Kunden ein Termin zum kostenfreien R\u00fccktritt vom Vertrag schriftlich vereinbart wurde, kann der Kunde bis dahin vom Vertrag zur\u00fccktreten, ohne Zahlungs- oder Schadensersatzanspr\u00fcche des Hotels auszul\u00f6sen. Das R\u00fccktrittsrecht des Kunden erlischt, wenn er nicht bis zum<br>vereinbarten Termin sein Recht zum R\u00fccktritt schriftlich gegen\u00fcber dem Hotel aus\u00fcbt, sofern nicht ein Fall des R\u00fccktritts des Kunden gem\u00e4\u00df Nummer 1 Satz 3 vorliegt.<br>3. Bei vom Kunden nicht in Anspruch genommenen Zimmern hat das Hotel die Einnahmen aus anderweitiger Vermietung der Zimmer anzurechnen.<br>4. Dem Hotel steht es frei, die vertraglich vereinbarte Verg\u00fctung zu verlangen. Der Kunde ist in diesem Fall verpflichtet, die folgenden anfallenden Stornierungskosten zu tragen: Bei Reservierungen bis einschlie\u00dflich 4 Zimmern bleibt eine Stornierung bis zum 15. Tag vor Anreise kostenfrei, ab dem 14. Tag fallen 50% der Gesamtkosten der Reservierung an. Ab dem 7. Tag vor Anreise fallen 70% der Reservierungskosten an und ab dem 2. Tag vor Anreise oder bei Nichtanreise (\u201cno show\u201d) fallen 90% der Gesamtkosten der Reservierung an. Bei Gruppenreservierungen ab 5 Zimmern oder mehr kann die Reservierung bis 8 Wochen vor Anreisedatum kostenfrei storniert werden. Ab der 8. Woche fallen 30% der Gesamtkosten der Reservierung an, ab 4 Wochen 50%, ab 2 Wochen 80% und ab 1 Woche vor Anreise 90% der Gesamtkosten an.<br>5. Bietet das Hotel einen Gruppenrabatt in Zusammenhang mit einer Anzahlung an, so ist diese auch nach Stornierung der Reservierung nicht mehr erstattbar. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>6. Bietet das Hotel nicht-erstattbare Raten an, so ist die Reservierung nicht mehr kostenfrei stornierbar und der Kunde hat keinen Anspruch mehr auf eine Erstattung der Vorauszahlung. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>V. R\u00fccktritt des Hotels<br>1. Sofern ein kostenfreies R\u00fccktrittsrecht des Kunden innerhalb einer bestimmten Frist schriftlich vereinbart wurde, ist das Hotel in diesem Zeitraum seinerseits berechtigt, vom Vertrag zur\u00fcckzutreten, wenn Anfragen anderer Kunden nach den vertraglich gebuchten Zimmern vorliegen und der Kunde auf R\u00fcckfrage des Hotels auf sein Recht zum R\u00fccktritt nicht verzichtet.<br>2. Wird eine vereinbarte oder oben gem\u00e4\u00df Klausel III Nr. 6 verlangte Vorauszahlung auch nach Verstreichen einer vom Hotel gesetzten angemessenen Nachfrist nicht geleistet, so ist das Hotel ebenfalls zum R\u00fccktritt vom Vertrag berechtigt. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>3. Ferner ist das Hotel berechtigt, aus sachlich gerechtfertigtem Grund vom Vertrag au\u00dferordentlich zur\u00fcckzutreten, beispielsweise falls<br>\u2022 h\u00f6here Gewalt oder andere vom Hotel nicht zu vertretende Umst\u00e4nde die Erf\u00fcllung des Vertrages unm\u00f6glich machen;<br>\u2022 Zimmer unter irref\u00fchrender oder falscher Angabe wesentlicher Tatsachen, z.B. in der Person des Kunden oder des Zwecks, gebucht werden;<br>\u2022 das Hotel begr\u00fcndeten Anlass zu der Annahme hat, dass die Inanspruchnahme der Hotelleistung den reibungslosen Gesch\u00e4ftsbetrieb, die Sicherheit oder das Ansehen des Hotels in der \u00d6ffentlichkeit gef\u00e4hrden kann, ohne dass dies dem Herrschafts- bzw. Organisationsbereich des Hotels zuzurechnen ist.<br>\u2022 ein Versto\u00df gegen oben Klausel I Nr. 2 vorliegt.<br>4. Bei berechtigtem R\u00fccktritt des Hotels entsteht kein Anspruch des Kunden auf Schadensersatz. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>VI. Zimmerbereitstellung, -\u00fcbergabe und -r\u00fcckgabe<br>1. Der Kunde erwirbt keinen Anspruch auf die Bereitstellung bestimmter Zimmer.<br>2. Gebuchte Zimmer stehen dem Kunden ab 15.00 Uhr des vereinbarten Anreisetages zur Verf\u00fcgung. Der Kunde hat keinen Anspruch auf fr\u00fchere Bereitstellung.<br>3. Am vereinbarten Abreisetag sind die Zimmer dem Hotel sp\u00e4testens um 11.00 Uhr ger\u00e4umt zur Verf\u00fcgung zu stellen. Danach kann das Hotel aufgrund der versp\u00e4teten R\u00e4umung des Zimmers f\u00fcr dessen vertrags\u00fcberschreitende Nutzung bis 12.00 Uhr 50% des vollen Logispreises (Listenpreises) in Rechnung stellen, ab 12.00 Uhr 100%.<br>3 Vertragliche Anspr\u00fcche des Kunden werden hierdurch nicht begr\u00fcndet. Ihm steht es frei, nachzuweisen, dass dem Hotel kein oder ein wesentlich niedrigerer Anspruch auf Nutzungsentgelt entstanden ist. > Erg\u00e4nzung durch Buchungsbestimmung \/ Hausordnung<br>VII. Haftung des Hotels<br>1. Das Hotel haftet mit der Sorgfalt eines ordentlichen Kaufmanns f\u00fcr seine Verpflichtungen aus dem Vertrag. Anspr\u00fcche des Kunden auf Schadensersatz sind ausgeschlossen. Hiervon ausgenommen sind Sch\u00e4den aus der Verletzung des Lebens, des K\u00f6rpers oder der Gesundheit, wenn das Hotel die Pflichtverletzung zu vertreten<br>hat, sonstige Sch\u00e4den, die auf einer vors\u00e4tzlichen oder grob fahrl\u00e4ssigen Pflichtverletzung des Hotels beruhen und Sch\u00e4den, die auf einer vors\u00e4tzlichen oder fahrl\u00e4ssigen Verletzung von vertragstypischen Pflichten des Hotels beruhen. Einer Pflichtverletzung des Hotels steht die eines gesetzlichen Vertreters oder Erf\u00fcllungsgehilfen gleich. Sollten St\u00f6rungen oder M\u00e4ngel an den Leistungen des Hotels auftreten, wird das Hotel bei Kenntnis oder auf unverz\u00fcgliche R\u00fcge des Kunden bem\u00fcht sein, f\u00fcr Abhilfe zu sorgen. Der Kunde ist verpflichtet, das ihm Zumutbare beizutragen, um die St\u00f6rung zu beheben und einen m\u00f6glichen Schaden gering zu halten.<br>2. F\u00fcr eingebrachte Sachen haftet das Hotel dem Kunden nach den gesetzlichen Bestimmungen, das ist bis zum Hundertfachen des Zimmerpreises, h\u00f6chstens \u20ac 3.500, sowie f\u00fcr Geld, Wertpapiere und Kostbarkeiten bis zu 800\u20ac. Geld, Wertpapiere und Kostbarkeiten k\u00f6nnen bis zu einem H\u00f6chstwert von 3.500 \u20ac (Versicherungssumme des Hotels einsetzen) im Hotelsafe aufbewahrt werden. Das Hotel empfiehlt, von dieser M\u00f6glichkeit Gebrauch zu machen. Soweit dem Kunden ein Stellplatz in der Hotelgarage oder auf einem Hotelparkplatz, auch gegen Entgelt, zur Verf\u00fcgung gestellt wird, kommt dadurch kein Verwahrungsvertrag zustande. Ausschlie\u00dflicher Gerichtsstand \u2013 auch f\u00fcr Scheck- und Wechselstreitigkeiten \u2013 ist im kaufm\u00e4nnischen Verkehr der Sitz des Hotels. Sofern ein Vertragspartner die Voraussetzung des \u00a7 38 Abs. 2 ZPO erf\u00fcllt und keinen allgemeinen Gerichtsstand im Inland hat, gilt als Gerichtsstand der Sitz des Hotels.<br>4. Es gilt deutsches Recht. Die Anwendung des UN-Kaufrechts und des Kollisionsrechts ist ausgeschlossen.<br>5. Sollten einzelne Bestimmungen dieser Allgemeinen Gesch\u00e4ftsbedingungen f\u00fcr die Hotelaufnahme unwirksam oder nichtig sein oder werden, so wird dadurch die Wirksamkeit der \u00fcbrigen Bestimmungen nicht ber\u00fchrt.
